By placing an order on our Website you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our Website or place an order.
2. Eligibility
Our Website is intended for use by consumers resident in the United Kingdom who are at least 18 years of age. By placing an order you confirm that you meet these requirements. We reserve the right to decline orders from outside the United Kingdom.
3. Products
We sell solar-powered outdoor and garden lighting products, including (but not limited to) solar wall lights, solar post lights, solar driveway lights, solar lawn and stake lights, solar security and motion sensor lights, solar decorative lights, solar lamps, and related accessories (“Products”).
All Products are intended for outdoor or garden use in the United Kingdom. Whilst our Products are weatherproof to the IP rating stated on the relevant product page, performance of solar-powered products depends upon adequate sunlight exposure and is naturally variable.
Product images on the Website are for illustrative purposes only. Colours may vary slightly from those shown due to monitor settings and natural product variation.
4. Ordering
4.1 Placing an Order
When you place an order through our Website you are making an offer to purchase the Product(s) at the price shown at checkout. All orders are subject to acceptance by us.
4.2 Order Confirmation
We will send you an email acknowledgement when we receive your order. This acknowledgement is not acceptance of your order. A binding contract is formed only when we despatch your order and send you a despatch confirmation email.
4.3 Right to Decline
We reserve the right to decline any order at our discretion, including where a Product is out of stock, where payment cannot be verified, or where we suspect fraudulent activity. In such cases we will notify you promptly and issue a full refund of any payment taken.
4.4 Pricing and VAT
All prices shown on the Website are in pounds sterling (GBP) and are inclusive of VAT at the applicable UK rate. Prices are subject to change without notice, but changes will not affect orders that have already been despatched.
5. Payment
Payment is required in full at the time of placing your order. We accept the payment methods displayed at checkout. All payment transactions are processed securely. We do not store your full card details on our systems.
If a payment is declined or subsequently reversed (chargeback), we reserve the right to cancel the relevant order and recover any Products already despatched.
6. Delivery
Full details of our delivery service are set out on our Delivery Information page. The key terms are:
- We offer free standard delivery on all orders to addresses within the United Kingdom.
- Estimated delivery times are provided as a guide only; they do not constitute a guaranteed delivery date.
- Delivery is made by our appointed carrier. You will receive tracking information where available.
- Risk in the Products passes to you upon delivery. Title to the Products passes to you upon receipt of payment in full.
- If delivery is attempted and no one is available, the carrier will follow their standard re-delivery or collection procedure.

7. Consumer Rights — Cancellation and Returns
7.1 Your Right to Cancel (Consumer Contracts Regulations 2013)
As a consumer you have the legal right to cancel your order without giving any reason within 14 days of the day after you (or someone you nominate) receives the Products. This is your statutory cancellation right.
To exercise this right, please inform us via our Contact Us page before the 14-day period expires. You must then return the Products within 14 days of your cancellation notice.
7.2 Our Extended Returns Policy
In addition to your statutory rights, we voluntarily extend our returns window to 90 days from the date of delivery for change-of-mind returns, provided:
- The Product is returned in its original, undamaged packaging.
- The Product is in a resalable, unused condition.
- The Product has not been installed or permanently fixed.
You are responsible for the cost of return postage for change-of-mind returns. We recommend using a tracked delivery service and obtaining proof of postage. We cannot accept responsibility for items lost in transit without evidence of despatch.
7.3 Faulty, Damaged, or Incorrect Products
If your Product arrives damaged or is not what you ordered, please notify us within 7 days of delivery via our Contact Us page. We will arrange for a replacement, repair, or full refund at no additional cost to you, including any return postage costs.
If a Product develops a fault within 90 days of purchase, you are entitled (at your option) to a full refund, a repair, or a replacement, in accordance with the Consumer Rights Act 2015.
Beyond 90 days, your rights under the Consumer Rights Act 2015 continue for up to six years (five years in Scotland). If a fault arises after 90 days, we may ask you to demonstrate that the fault was present at the time of purchase.
7.4 Refund Processing
Once we receive and inspect the returned Product, refunds will be credited to your original payment method within 5 business days. For cancellations under the Consumer Contracts Regulations 2013, we will refund you within 14 days of receiving the returned goods or proof of return, whichever is earlier.
8. Warranty
All Products are sold with a minimum 12-month manufacturer’s warranty against defects in materials and workmanship from the date of delivery, unless a longer warranty is stated on the specific product page. This warranty does not affect your statutory rights under the Consumer Rights Act 2015.
The warranty does not cover:
- Fair wear and tear.
- Damage caused by misuse, negligence, improper installation, or failure to follow product instructions.
- Damage caused by weather events beyond normal UK outdoor conditions.
- Consumable parts such as batteries, unless defective from manufacture.
- Products that have been modified or repaired without our authorisation.
9. Limitation of Liability
Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be excluded by law; or (d) your statutory rights as a consumer.
Subject to the above, our total liability to you in connection with any order shall not exceed the price paid by you for the Products in that order.
We are not liable for: (i) any loss that was not foreseeable at the time of contract; (ii) any loss arising from your misuse of the Products; or (iii) any loss that is a business loss (our Products are sold for consumer, domestic, and garden use only).
10. Intellectual Property
All content on the Website, including text, images, graphics, logos, and product names (including Max Lumen product names), is the property of Hoska Ltd or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, or use any such content without our prior written consent.
11. Privacy and Cookies
We take your privacy seriously. Our Privacy Policy explains how we collect, use, and protect your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

We take reasonable steps to ensure the Website is available and accurate, but we do not warrant that the Website will be uninterrupted, error-free, or virus-free. We reserve the right to suspend or withdraw the Website at any time without notice.

If we are unable to resolve a dispute to your satisfaction, you may refer the matter to an alternative dispute resolution (“ADR”) provider. We are not currently subscribed to a specific ADR scheme, but you may also use the European Commission’s Online Dispute Resolution (“ODR”) platform at https://ec.europa.eu/consumers/odr/ for disputes relating to online purchases.

We reserve the right to update or amend these Terms at any time. The version of the Terms in force at the time you place your order will apply to that order. We will post any updated Terms on the Website with a revised “Last updated” date.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to your rights as a consumer to bring proceedings in the courts of your country of residence.
17. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
18. Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, Delivery Information, and Returns Policy, constitute the entire agreement between you and us in relation to your purchase and supersede any prior representations or arrangements.
